Terms of Service

The plain-English version: Online Business Generator gives you the software to run your own online shop. The shop, the products and the customers are yours. You pay a monthly subscription and a small fee on each sale. Treat your customers honestly, sell only what is legal, and we will look after the platform. Cancel whenever you like.

This summary is here to help, but the sections below are the actual agreement.

1. Who we are and what these terms cover

Online Business Generator (“OBG”, “we”, “us”) is an Australian software platform that lets small retailers create and run their own online shops. It is operated by Last Third Pty Ltd as trustee for the NFWTH Trust, trading as Online Business Generator (ABN 47 378 564 806), of Mandurah, Western Australia. These terms are an agreement between OBG and the business that creates an account (“you”). By creating an account, or by continuing to use the platform, you accept them. If you are accepting on behalf of a business, you confirm you have authority to do so.

Shoppers who buy from a shop powered by OBG are customers of that shop, not of OBG. Their purchase is governed by that shop’s own policies and Australian Consumer Law.

2. What the platform is (and is not)

OBG provides the software: your storefront, product listings, cart and checkout, order management, email tools, analytics and the other features described on our features page. We also offer optional human help by phone or video call.

OBG is not a party to any sale made through your shop. We are not a marketplace, agent, or reseller. You are the seller of record for everything sold in your shop.

3. Who can open an account

  • You must be at least 18 years old.
  • You must be running, or setting up, a genuine business. We built OBG for Australian retailers and the platform assumes Australian law, dollars and postage.
  • The details you give us (name, business name, contact details and, where you have one, ABN) must be accurate and kept up to date. You are responsible for your own business registrations and tax obligations.

4. Your account and team

Keep your password private and your login details secure. You are responsible for what happens under your account, including what your team members do. Team member limits depend on your plan. Tell us immediately at info@onlinebusinessgenerator.com if you suspect someone else has accessed your account.

5. Free trial, plans and billing

Trial. New shops get a 14 day free trial with no payment card required. When the trial ends, your shop goes offline until you subscribe. Your products and settings are kept so you can pick up where you left off.

Plans. Current plans and prices are shown on the pricing page. Subscription prices are in Australian dollars plus GST, which is added at billing and itemised on your invoice. Subscriptions are billed monthly in advance through our payment provider, Stripe.

Cancelling. You can cancel any time from your dashboard. Cancellation takes effect at the end of the billing period you have already paid for. We do not refund partial months, except where Australian Consumer Law requires it.

Failed payments. If a subscription payment fails we will retry and email you. While an account is unpaid, the shop may be taken offline. We may change plan prices with at least 30 days notice by email; if you do not accept a price change you can cancel before it takes effect.

6. Fees on sales

Each sale made through your shop is subject to a platform fee (currently 2.2% of the transaction) plus Stripe’s card processing fees at Stripe’s published rates. Both are deducted automatically when the payment is processed; the rest settles to your own Stripe account. There are no listing fees and no limits on products or orders.

Optional extras (for example additional support calls or AI photo credits) are priced in the app at the point you buy them.

7. Getting paid: your Stripe account

To accept payments you connect your own Stripe account. Money from your sales flows directly from your shopper to your Stripe account. OBG never holds your money. Your use of Stripe is also governed by Stripe’s terms, including their identity checks. Chargebacks and payment disputes for your sales are between you, your shopper and Stripe; we will help with information where we can.

8. Your shop is your business

You are responsible for:

  • your products: their descriptions, photos, pricing, quality, safety and legality, and any licences they need (for example food handling);
  • delivering orders within the time you promise;
  • refunds, returns and remedies for your shoppers as required by Australian Consumer Law and your own policies;
  • your own taxes, including GST if you are registered; and
  • handling your customers’ information lawfully (see our Privacy Policy for how the platform handles it on your behalf).

9. Your content and our platform

Everything you upload (product photos, descriptions, your logo, your brand) remains yours. You give us permission to host, display, back up and process it as needed to run your shop, including generating the AI images or text you ask for. We claim no other rights over it.

The platform itself (the software, design and the Online Business Generator name) belongs to us. Your subscription gives you the right to use it while your account is active; it does not transfer any ownership.

10. AI features

The platform can draft product descriptions and generate model photos using artificial intelligence, always at your request. You must review AI output before publishing it: you are responsible for what appears in your shop, including that descriptions are accurate and images do not mislead your shoppers. Where the law or a marketplace requires AI imagery to be disclosed, that disclosure is your responsibility, and we provide labelling to help.

11. Acceptable use

You must not use the platform to:

  • sell anything illegal, counterfeit, stolen, or subject to recall; weapons; illicit drugs; or age-restricted goods without the required controls;
  • mislead shoppers, or take payment for goods you cannot supply;
  • send spam. Marketing emails through the platform go only to people who have opted in, as required by the Spam Act 2003, and every marketing email carries an unsubscribe link that must not be removed;
  • probe, overload or interfere with the platform’s security or other shops’ data; or
  • resell or white-label the platform without our written agreement.

We apply fair-use limits (for example on email volume and AI generation) to keep the platform fast and affordable for everyone.

12. Availability and support

We work hard to keep the platform online and fast, and we monitor it around the clock, but no software service can promise 100% uptime. Planned maintenance will be scheduled outside busy shopping hours where possible. Support is available through the Help Centre, by email, and by the support calls included in your plan.

13. Suspension and closing accounts

We may suspend or close an account that breaks these terms, does not pay, or puts the platform, other shops or shoppers at risk. Unless the situation is urgent we will contact you first and give you a chance to put things right. You can close your account at any time. After an account closes we keep your data for a reasonable period in case you return, and you can ask us for an export of your products and orders.

14. Liability

Nothing in these terms excludes rights you have under Australian Consumer Law, including consumer guarantees that cannot be excluded. Where we are allowed to limit liability: our total liability to you in any 12 month period is capped at the subscription fees you paid us in that period, and neither of us is liable to the other for indirect losses such as lost profits. You are responsible for claims arising from your own products and your own conduct toward your shoppers.

15. Changes to these terms

As the platform grows these terms will evolve. For material changes we will email the account owner at least 14 days before they take effect. Continuing to use the platform after that date means you accept the updated terms; if you do not, you can cancel first.

16. The general bits

These terms are governed by the laws of Western Australia, and disputes belong to the courts of Western Australia. If part of these terms turns out to be unenforceable, the rest still stands. These terms, the Privacy Policy and the prices shown in the app are the whole agreement between us.
